New legislation. Hard to get copies of pre-filed legislation, but DJC plans to allow us to look at their proposed legislation. Doug will be getting copies of whatever is available, and disburse to members. One piece of legislation deals with the supervision of Probation and Detention. Patty Tobias said that she believes that both aspects of that bill will be pulled.

Discussion was held concerning Supreme Court Chief Justice Trout, who is traveling around the state. Please take the time to talk with her when she visits your district and express concerns that you have about juvenile justice.

Ron Sipe---DJC Legislation-(1.) multiple commitments, (2.) Contracting with Health and Welfare concerning Child Support, and (3.) Sentencing guidelines of kids using "combined sentencing."

Ron discussed the contacting of Governor Kempthorne’s transition team. We should contact Ms. Teddy Keeton at 543-4690 of that team by today (12-2-98) in order to have input to the team for their presentation on December 4.

Jim Shackleford. Executive Director of the Idaho Education Association, working with PERC. Public Employee Retirement Coalition. Representing PERSI enrollees. Brief overview of PERSI and proposals to improve the PERSI retirement plans, bringing them up to speed with surrounding state’s systems and plans. Question asked concerning our rule of 90 retirement—The proposed guidelines will not address this problem. Our organization is welcome to join the PERC to help push legislation to improve PERSI for all enrollees. Discussion after Mr. Shackleford’s presentation—MS Positive benefits may be realized through an alliance with PERC. MS motioned that the Mr. President Brown contact the Supreme Court to find out their feelings on our involvement with PERC, and if there is no opposition from the Supreme Court, then we join PERC. Steve Dye second. Motion passed unanimously.

Lunch.

Discussion of DJC submitted legislation-----1. DJC can contract with DHW for child support enforcement. 2. Combined or Blended sentencing. Concern is with putting kid into the adult system without the benefits that come with the adult court system-no waiver hearing, no bond opportunities, no jury trial, etc. Also, the issue of magistrate judges imposing prison sentences is another issue. It seems that because blended sentencing capability already exists through the waiver process—District Court Judges may utilize juvenile sentencing guidelines—that this would be a waste of time, and bring into play too many legal questions. In the statement of purpose, it is stated that there is a need to enact blended sentencing for serious juvenile offenders committing violent crimes at very young ages when they may not be suitable for initial prosecution as adults. If they are not suitable for prosecution as adults, why are they suitable for treatment as adults? 3 Waive jurisdiction to district court.

Items for the Joint DJC/IACJJA Meeting.

  1. Joint concerns with DJC and IACJJA .
  2. Combined service plan as it relates to the risk assessment tool. This may have been dropped from tomorrow’s meeting agenda. Categorization of offenses must be looked in more detail.
  3. 90-30-2 proposal-not much info is available, but designed for recommitments. Proposal needs to have more input and consideration.
  4. System wide program components
  5. System wide mission statement
  6. System wide outcome measures

COGNET. Problems in using program designed for adults on a long term basis. CSC. Need an adapted program that will fit the adolescent mind with short term programs. JCC East is coming out with a program entitled "thinking for a change" that may fit better. Based on Phase II with fewer thinking errors.

JFAC Committee testimony. Debbie Stallcup has been asked to testify in front of JFAC and asked for input as to what topics the Association wants to have brought up to the committee. Items such as block grants, cigarette tax specifics, etc.

Compliance Monitoring. Mike Stallcup brought up a letter written by Stan Tate on Nov 23. Addressed in the letter are allegations in the compliance monitoring project that Al Friesen acted inappropriately. Motion was made by SJ to reply to Tate’s letter through Sharon Harrigfeld(to be distributed to all commission members to be CC’d to Batt and Reinke) Seconded by Jim Lawless. Motion carried.

JJTA training. Juvenile Corrections Careworkers Training Curriculum was researched by Steve Jett for the detention Centers. There is a 2 ½ day seminar to train people to be trainers or the full 40 hour course. There was a consensus that we look at the 2 ½ day train the trainer seminar so that we can perpetuate the training in the state without bringing the JJTA personnel back. Steve will get more info, such as dates, what certification would be obtained by those attending, etc. He will get to the detention centers and line things up.

Next meeting will be in Coeur d’Alene on January 21, 1998 at the Kootenai County Administration Building at 501 Government at 1000 hrs.
