IACJJA Meeting

Meeting was opened at 1010. 

Introductions

Quarterly Meetings of our Association and the scheduling of meetings was discussed.  We decided to meet in September at IJJA, December in Boise, March in McCall, and have a floating meeting in June.  This year’s (2000) meeting in June will be in Coeur d’Alene.  The meeting scheduled for the IJJA conference can be on the last day of the conference either after the closing session (or instead of the closing session decides to cancel the session in future conferences). The meetings will be Mar 8, 2000 in McCall, June 21, 2000 in Cd’A, December 6, 2000 in Boise.  The meetings will start at 1000 hrs.  We also briefly discussed having the members RSVP to the secretary by at least three days prior to the meeting so that the correct number of lunches can be ordered.  We do not want to buy too many lunches. 

We also talked about the sharing of information between members and making decisions outside the boundaries of the meeting.  JoAnne simply suggested that we keep on using the email information system and we should all be responsible and answer email if a response is requested.  Please send current email information to Steve so that we have an accurate listing for all administrators.

It was motioned by Nadine MacDonald that the minutes be approved, this was seconded by Steve Barton.  Passed unanimously.

Treasurers Report  Don Garner reported that there is $3360.42 in bank account.

He also wants to send out a REMINDER TO PAY DUES FOR IACJJA MEMBERSHIP. If you do not have the paperwork please let Don know. 

Doug passed out proposed legislation regarding victim’s rights.  This has an issue about the probation department’s duties as outlined in Section 3c.  Some of the counties have victim’s rights matters handled by the Prosecuting Attorney’s office.  Differences in regions and counties will further cloud this issue. Also, section 1h gives the victims the right to read the social history of the perpetrator, and require the victim to keep the information confidential.  This legislation came out of a task force put together by the Idaho Youth Ranch.  If you have input, please contact Mike Jones at the Idaho Youth Ranch.

 Legislative proposals recommended by the Juvenile Justice Advisory Team of Magistrate Judges during the meeting of November 2, 1999 was passed out by Doug. 

 The length of probation allowable being extended to 21st Birthday for sex offenders was discussed

 The issue of having court ordered restitution paid first, and any other court ordered payments after restitution is paid.

 Bill Lasley passed out bills from DJC. 

1.      Community based facility or staff secure facility legislation discussed. 

2.      19-2601 to allow waived juvenile to be supervised after release by juvenile probation and allow blended sentences.  Some of the problem behind the sentencing issue deals with licensing issues with facilities, and whether or not they may hold juveniles after they turn 18.  Some of the bill is not clear enough to satisfy PA’s and some probation administrators.

3.      Escapes.  Makes it clear that if a kid is in the custody of the state, if they escape after being charged with a charge that would be a felony, the escape charge would be a felony.

4.      Escapes. Allows the Director of the Department of Juvenile Corrections to issue an administrative order to apprehend escaped juvenile.

Doug wanted to have volunteers to help on the standards for juvenile probation officers.  The following people volunteered:

Billy will be the contact person for the group. 

 

Feedback was very positive about the Handle With Care training that was conducted in November.  A letter was written to the Juvenile Justice Commission thanking them for their support and summarizing the responses that were received.  Steve Jett asked to be on the agenda to thank them but the agenda was full. 

 Roch Clapp asked for continuing input on training issues.  He plans to continue meeting with all administrators for ideas.  Input requested for juvenile detention academy---length, grandfathering old-timers, certification of detention officers, etc.   A one week academy was discussed and prioritizing training topics will be important because of the short time period.  We also talked about OJT training after the academy that may be considered.  Roch proposed that the detention center administrators meet with him and discuss the program.  A meeting will be scheduled to accomplish that.   Frequency of the academy also discussed.  Making the training mandatory or voluntary is an issue.  Also, is the full training program being mandated for part-time employees? 

 Also, certification of juvenile detention centers will be Roch’s other duty, and he talked about his plan to inspect the centers in March. 

 The Writ of Habeas Corpus that was filed in Latah County for keeping over 18 year old kid in Juvenile Detention was discussed.  The writ was withdrawn. 

 1-step drug detection  program information was passed out to members. 

 NJDA Membership was encouraged, and membership application was passed out. 

 Lunch was served.

Drug and Alcohol issues

 There seems to be confusion as to whether funding is flexible with Subs abuse $.  Determination regarding flexibility is made on the regional level.  Federal funds usually do not have a lot of limitations on flexibility except for those funds earmarked for women and children. Also, additional funding has been added for families.  Residential Treatment is one place where flexibility is limited.  Roseanne Hardin will get information to Doug for distribution to members.  Some confusion still exists as to who qualifies for services.  Bill suggested gatekeeping training throughout the state. 

 1-800-##    very inconsistent screenings, eligibility sometimes the issue, some very detailed, some too brief,

 Eligibility  Only the child’s income considered.  Upper limit is 175% of poverty.  Also, under 16, parent’s permission required. 

 Information on Children’s Health Insurance Program passed out.
